1. Scope
These terms apply to Business Mail Services, a brand of pCube Software Solution, and cover business email consultation, plan recommendation, licensing assistance, account setup, DNS support, email migration, hybrid mail planning, support, renewals, and related professional services.
2. Quotes and orders
All quotations are indicative unless confirmed in writing. Pricing, taxes, currency, features, plans, and availability may change due to third-party vendor policies, exchange rates, taxes, provider revisions, or business decisions. An order is accepted only after written confirmation and receipt of required payment or approved commercial terms.
3. Customer responsibilities
- You must provide accurate company, billing, domain, user, and technical information.
- You must maintain access to domain, DNS, admin accounts, old email provider, billing contacts, and recovery channels.
- You are responsible for internal approvals, data backup, user communication, legal compliance, and timely decisions.
- Delays caused by missing access, incomplete information, third-party issues, or customer-side approvals may affect timelines and are not our liability.
4. Third-party products
Microsoft 365, Google Workspace, Zoho Mail, domain, hosting, WhatsApp, payment, and other third-party products are governed by their own terms, pricing, policies, uptime, data practices, suspension rules, and support processes. We are not liable for third-party downtime, policy change, price change, data loss, feature withdrawal, account restriction, or service discontinuation.
5. No guaranteed outcome
We provide professional effort and practical guidance, but we do not guarantee uninterrupted email operation, specific business results, data recovery, migration completeness where source data is unavailable, spam-free mailboxes, email deliverability to every recipient, or uninterrupted service from third-party providers.
6. Payments and renewals
Payments must be made in advance unless otherwise agreed in writing. Renewals are the customer's responsibility and must be paid before due dates. Non-payment, delayed payment, chargeback, or billing dispute may result in suspension, delayed support, license expiry, data loss, or service termination by third-party providers.
7. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim is limited to the amount paid by the customer to us for the specific service directly giving rise to the claim during the immediately preceding one month. We are not liable for indirect, incidental, special, punitive, consequential, business interruption, data loss, revenue loss, profit loss, reputational loss, or third-party claims.
8. Indemnity
You agree to defend and indemnify Business Mail Services, pCube Software Solution, owners, staff, partners, and service providers against claims, losses, penalties, costs, and expenses arising from your misuse, inaccurate information, unlawful content, customer-side security failure, non-payment, breach of these terms, or violation of applicable law.
9. Governing law and jurisdiction
These terms are governed by the laws of India. Subject to applicable law, courts and authorities having jurisdiction over Palanpur, Gujarat, India shall have exclusive jurisdiction for disputes.
